PRIVACY POLICY

Please read our Terms of Service and this Privacy Policy carefully, as you must agree to both documents in order to be permitted to use our Services.  This Privacy Policy governs your use of the website under the domain name www.clairvoyantfinancial.com (“Site”), the software application entitled “Clairvoyant” (the “App”) and related services available or accessible through the Site and App (the “Services”) that are offered by Clairvoyant Inc. (the “Company” or “We” or “Us”).

 

This Privacy Policy describes the information we collect from you, how we use and disclose such information, and the steps we take to protect your information.  By using the Services, you consent to the privacy practices described herein.  Please note that this Privacy Policy is incorporated into and is subject to the Clairvoyant Terms of Use Agreement (“Terms”).  Capitalized terms that are not defined in the Privacy Policy have been given meaning and defined in the Terms.

 

  1. Information We Collect

 

User-provided Personal Information

When you use the Services, you may provide and we may collect what is generally called “personally identifiable” information, such as your name, e-mail address, mailing address, mobile phone number, social security number, credit card information, and demographic information. For example, you will have to provide us with personally identifiable information when you fill out forms or fields on the Site or App, when you contact us or request information about us, this Site, App and our Services (whether by email or other means), when you submit feedback, and when you register for an account.

When you use certain portions of our Services you may be asked to fill in and submit a form that collects, in addition to your personally identifiable information, your personal financial information, such as your current income level, current expenses, investable assets, and other financial information.

 

“Cookies” Information

When you use our Services, we may send one or more cookies – small text files containing a string of alphanumeric characters – to your device.  We may use both session cookies and persistent cookies.  A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to our Services.  Persistent cookies can be removed.  Please review your web browser “Help” file to learn the proper way to modify your cookie settings.  Please note that if you delete, or choose not to accept, cookies from our Services, you may not be able to utilize the features of the Services to their fullest potential.


“Automatically Collected” Information

When you use our Services or open one of our HTML e-mails, we may automatically record certain information from your web browser by using different types of technology, including “clear gifs” or “web beacons.”  This “automatically collected” information may include your IP address or other device address or ID, web browser and/or device type, the web pages or sites that you visit just before or just after our Services, the pages you view on the Services, your actions on the Services, and the dates and times that you visit, access, or use the Services. 

 

When using our Services, the following activity will also be collected and recorded to help us improve our Services:

  1. Launch counts on the following pages: Home Screen, Search Screen, Efficient Frontier, Portfolio Optimization Weights, View Saved Portfolio, All Forecasting Models, Probability Based Models, Technical Analysis Models, Variable Selection Models, Expected Return Models, Options Pricing and Fundamentals, Alerts, Top Ten Recommended Stocks in S&P 500, and Market Scan;
  2. Stocks on Home Screen (Symbol, name of Company, type of Stock, exchange stock is listed on);
  3. Time-stamp of the stocks on Home Screen, time-stamp of save date on Save a New Portfolio, and time-zone of user;
  4. Counts to portfolio optimization from Home Screen and Efficient Frontier;
  5. Counts to save the portfolio and historical statistics of portfolio;
  6. Number of times you select “Quick Optimization on Home Watchlist” and “Build and Optimize a Custom Portfolio” on Portfolio Build Screen;
  7. Selected index of optimized portfolio, expected return/risk of the portfolio;
  8. Name of saved portfolio, stock symbols in the portfolio, time-stamp of save date of portfolio, and indicator for preferences to receive re-balancing notifications of portfolio;
  9. Counts to detailed view of forecast, Intra-day modeling, day modeling, options pricing, information screen, number of simulations ran, and forecast frequency and interval from All Forecasting Models;
  10. Counts to information screen and Accuracy screen from Probability Based Models;
  11. Counts to information screen and settings screen from Technical Analysis Models;
  12. Counts to information screen and parameter estimation screen from Variable Selection Models;
  13. Counts to information screen from Expected Return Models, Options Pricing and Fundamentals;
  14. Indicators for which alerts you would like to receive for any particular security;
  15. Counts to information screen from Top Ten Recommended Stocks in S&P 500; and
  16. Counts of selected indicators and selected time-frames from Market Scan.

 

Third Party Web Beacons and Third Party Buttons

We may also implement third party content, or advertising on our Services that may use clear gifs or other forms of web beacons, which allow the third party content provider to read and write cookies to your browser in connection with your viewing of the third party content on the Services.  Additionally, we may implement third party buttons (such as Facebook “like” or “share” buttons) that may allow such third party to collect information about you through such third party’s browser cookies, even when you do not interact with the button.  Information collected through web beacons and buttons is collected directly by the third party, and Clairvoyant does not participate in that data transmission.  Information collected by a third party in this manner is subject to that third party’s own data collection, use, and disclosure policies.

 

Third Party Analytics Frameworks

Google Firebase Analytics, Google Web Analytics, and Apple App Store Analytics: In addition to the foregoing, we currently use three analytics tools: Google Firebase, Google Web Analytics, and Apple App Store Analytics.

 

Google Web Analytics help us understand the use of our site by our visitors.  Because Google Analytics require cookies to function, users who wish to avoid tracking by Google Analytics while on our site can disable cookies on their web browsing software (see above).  Google Analytics is a web analytics service provided by Google, Inc. (“Google”).  Google Analytics uses “cookies” to help the Site analyze how users use the site.  The information generated by the cookie about your use of the Site (including your IP address) will be transmitted to and stored by Google on servers in the United States.  Google will use this information for the purpose of evaluating your use of the Site, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage.  Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. Google will not associate your IP address with any other data held by Google.  You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this, you may not be able to use the full functionality of this Site.  By using this Site, you automatically consent to the processing of data about you by Google in the manner and for the purposes set out above.

 

Firebase Analytics is a mobile analytics service also provided by Google and governed by the Firebase Analytics terms of service.  This service helps Clairvoyant understand our users and how they use our App, including information about interactions with the user’s mobile applications.  Firebase Analytics uses identifiers for advertising on mobile applications (for example, Android Advertising ID and Advertising Identifier for iOS), and we will collect the AAID and AIiOS to understand our users, but users who wish to opt-out of the AAID and AIiOS advertisement tracking can do so through device advertising settings for mobile apps and users who wish to avoid tracking by Firebase Analytics can opt-out in application settings.  Data collected will be transmitted to and stored by Google on servers globally.  Similarly, Apple App Store Analytics is a mobile analytics service provided by Apple and gives us insight as to how users engage with the App, what types of purchases users make on the app, and how our users respond to advertisements so that we can build and improve upon our iOS app.

 

Crash Reporting: We currently use two Crash Reporting services on our mobile applications: Firebase Crash Reporting provided by Google and Fabric Crashlytics provided by Twitter, Inc. To enhance your user experience and to improve the stability of mobile applications, Clairvoyant uses Crash Reporting services to collect information about the devices that use and your use of our applications (for example the timestamp of when you launched the application and when the crash occurred) which enables us to diagnose and resolve problems.  However, if you do wish to opt-out of this data collection via Firebase Crash Reporting and Fabric Crashlytics, you can do so via the application settings in our mobile applications.  The data collected will be transmitted to and stored by Google (Firebase Crash Reporting) and by Twitter (Fabric Crashlytics) on servers globally.

 

Information from Other Sources

We may also obtain information, including personally identifiable information, from third parties and sources other than the Service, such as our partners or advertisers.  We may also, at your direction, receive information from third party services that provide a mechanism to expose information you have provided to such third party through the use of an application program interface (API), such as Facebook Connect or the Twitter API. If we combine or associate information from other sources with personally identifiable information that we collect through the Service, we will treat the combined information as personally identifiable information in accordance with this Privacy Policy.

 

  1. How We Use the Information Collected

Your information is an integral part of our operations, and we use it in a variety of ways in providing our Services and operating our business.  We may use the information that you provide or that we collect for purposes about which we notify you.  We use the information that you provide or that we collect, to operate, maintain, enhance and provide all of the features of the Services, such as conducting academic research and constructing financial models.  We use all of the information that you provide and that we collect to understand and analyze the usages trends and preferences of our users, to improve our Services, and to create new features and functionality.  We may also use your e-mail address or other personal information (a) to contact you for administrative purposes such as customer service, to address intellectual property infringement, right of privacy violations or defamation issues related to your feedback posted on the Services or (b) to send you promotional materials, offers, messages related to the Services and the activities of third parties with which we work.  Generally, you have the ability to opt-out of receiving any such communications, either through links provided in the messages, by updating your account preferences through the Services, or by contacting us directly at support@clairvoyantfinancial.com.

 

We may use “cookies“ information and “automatically collected“ information to: (a) personalize our services, such as remembering your information so that you will not have to re-enter it during your visit or the next time you visit the Services; (b) provide customized advertisements, content, and information; (c) monitor and analyze the effectiveness of Services and third party marketing activities; (d) monitor aggregate site usage metrics such as total number of visitors and pages viewed; and (e) track your entries, submissions, and status in any promotions or other activities.

 

  1. Your Privacy Options

You can decline to share certain personally identifiable information with us.  However, we may not be able to provide to you with some of the features and functionality of the Services if you do not share your personal or financial information with us.  If the Site and/or App allows you to create an account with us, you may update, correct, or delete your profile information and preferences at any time by accessing your account preferences page through the Services.  If you do not have an account with us and want to delete your personally identifiable information, please send your request at support@clairvoyantfinancial.com.  

 

If you do not wish to receive email offers or newsletters from us, you can opt-out of receiving email information from us (except for emails related to the completion of your registration, correction of user data, change of password and other similar communications essential to your transactions on the Site and App) by using the unsubscribe process at the bottom of the email.  Please note that while your changes are reflected promptly in active user databases, we may retain all information you submit for a variety of purposes, including backups and archiving, prevention of fraud and abuse, and analytics.

 

  1. Third Party Services

The Services may contain features or links to websites and services provided by third parties. Any personally identifiable information you provide on third party sites or services is provided directly to that third party and is subject to that third party’s policies, if any, governing privacy and security, even if accessed through the Services.  We are not responsible for the content or privacy and security practices and policies of third party sites or services to which links or access are provided through the Services.  We encourage you to learn about third parties’ privacy and security policies before providing them with personally identifiable information.

 

  1. Children’s Privacy

We strictly prohibit the use of the Site, App, and Services by children under 13 years of age.  We never knowingly collect or maintain personally identifiable information from persons under 13 years of age, and no part of the Services is directed to persons under 13 years of age.  

 

If you are under 13 years of age, then please do not use or access the Site, App, or Services at any time or in any manner.  If we learn that personally identifiable information has been collected through our Services from persons under 13 years of age, without verifiable parental consent, then we will take the appropriate steps to delete this information.  If you are a parent or guardian and discover that your child under 13 years of age has obtained an account through our Services or provided us with personal information, then you should alert us at support@clairvoyantfinancial.com to request that we delete the personal information from our systems.

 

  1. Data Security

We care about your data security, and we take certain measures to enhance the security of our Site, App, and Services, including limiting access to our databases to a few physical locations and encrypting all users’ passwords on Google servers to an extent that we ourselves can never view them.  However, we cannot ensure or warrant the security of any information you transmit to us or store through our Services and you do so at your own risk.  We also cannot guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

Although we may allow you to adjust your privacy settings to limit access to your information, please be aware that no security measures are perfect or impenetrable.  We cannot control the actions of other users with whom you may choose to share your information.  Thus, we cannot and do not guarantee that information you post on our Services will not be viewed by unauthorized persons.  We are not responsible for circumvention of any privacy settings or security measures contained on the Site.

 

By using our Services, you understand and acknowledge that, even after removal, copies of information that you have posted may remain viewable in cached and archived pages or if other users have copied or stored such information.

 

  1. International Visitors

Our Services are hosted in the United States and is intended solely for visitors located within the United States.  If you choose to use the Service from any other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that you are transferring your personal information outside of those regions to the United States for storage and processing, and by providing your personally identifiable information on the Services you consent to that transfer, storage, and processing.

 

  1. Mergers & Acquisition

You should be aware that Registration Information may be transferred to a third party as a result of a sale, acquisition, merger, reorganization or other transfer involving Clairvoyant. We specifically reserve the right to transfer Registration Information to a third party in connection with such a transfer.  Should such a transfer occur, we will use our best efforts to require that the new combined entity follow our Privacy Policy with respect to your personally identifiable information.

 

Clairvoyant reserves the right to modify this policy at any time, so please review it frequently.  In the event that a change to the Privacy Policy materially modifies your rights or obligations, you will be required to accept such modified terms in order to continue to use the Services.  Modifications are effective upon your use or access of the Site, App, and/or Services immediately following publication.  Disputes arising hereunder will be resolved in accordance with the Privacy Policy in effect at the time the dispute arose.
